Description

When a mortgage borrower enters into a Chapter 13 bankruptcy plan a whole new set of rules govern the activities of the mortgage servicer(s) collecting on those loans. Post-petition problems can arise during the bankruptcy but also after a successful debtor completes his/her Chapter 13 plan. This session will discuss the advantages and disadvantages related to: (i) claims that arise in these situations, (ii) whether to pursue the claims in the bankruptcy court, and (iii) whether to pursue the claims outside of the bankruptcy court setting.
