For advocates handling mortgage servicing and foreclosure cases, understanding and leveraging the privately enforceable mortgage servicing rules should be an essential part of your toolkit. This two-day intensive will provide an overview of the mortgage servicing rules contained in the Real Estate Settlement Procedures Act (and its implementing regulation, Regulation X) and the Truth in Lending Act (and Regulation Z). Each day, we will have two 90-minute sessions that involve a combination of live presentation and break-out group discussions. This intensive is designed for advocates who are new to handling mortgage cases or who want a comprehensive overview, starting from the basics. Topics we will cover include: the Loss Mitigation Rule and dual tracking protections (Section 1024.41), Qualified Written Requests, helping successors in interest, periodic mortgage statements, prompt crediting of payments, accurate payoff quotes, force-placed insurance, and pleading and litigation issues.
