Just because you fell behind on the mortgage doesn’t mean they should send someone to break into your home. Servicers claim to use property preservation companies to verify whether the home is occupied and make sure the collateral is not at risk. But all too often, these companies go far beyond what is reasonably necessary to protect the home or prevent waste. This session will include a discussion of the claims, defenses, issues, and strategies involved in litigating property preservation and home break-in cases.
