Description

This is a federal court class action alleging Truth in Lending and state law violations involving the understatement of the amount financed and APR  in a used automobile sale.  The action also alleges that the sale of a service contract prevents disclaimer of implied warranties and that there were breaches of implied warranties, leading to remedies under the Magnuson Moss Consumer Warranty Act and the Uniform Commercial Code. The action is brought against both the dealer and pursuant to the FTC Holder Notice, against the finance company assignee of the installment sales agreement.
