This course will examine the challenges and successful strategies in FCRA actions brought by victims of identity theft committed by a family member and victims of economic abuse. The panelists will discuss the unique defenses asserted in such cases and how to overcome defense claims of collusion, responsibility for, and knowledge of the debt. The session will examine the subject of "coerced debt." The panel will consist of legal aid and private attorneys and will present examples from a recent case involving economic abuse and coerced debt brought against the Big 3 CRAs and a large bank. The panel will also discuss emerging trends and state law remedies for victims of economic abuse.
