Automobile Fraud: WEST VIRGINIA

State Odometer Statute: W. Va. Code § 17A-3-12a

Prohibited acts: Failure of transferor to comply with federal odometer disclosure requirements or to knowingly give a false disclosure statement to transferee.

Criminal penalties: Not more than six months imprisonment in the county jail and a fine of not less than $200 and not more than $1000.

As described in Chapter 2, supra, obtaining a title history search from a state department of motor vehicles is often a critical step in an automobile fraud investigation. Because of the Driver Privacy Protection Act, applicants must indicate the use they will make of this data and must supply the state with other information.

In order to obtain a title search from the District of Columbia Department of Motor Vehicles, you must go to one of the three service centers listed: Georgetown Service Center, Georgetown Park Mall—Lower Level, 3222 M Street, N.W., Canal Level, Washington, DC 20007; or Southwest Service Center, 95 M Street, S.W., Washington, DC 20024. There is a $7 fee to obtain a title history. The form to request a title search is not available on the District DMV’s website: http://dmv.dc.gov.
