1.1.2 This Treatise’s Appendices

Mortgage Lending’s appendices are available in print and online. Appendix A, infra, is a state-by-state listing of state mortgage lending and mortgage loan originator laws. Appendix B, infra, provides summaries of state predatory lending laws. Appendix C, infra, sets out selected provisions of the Real Estate Settlement Procedures Act and related regulations. Appendix D, infra, discusses Truth in Lending Act materials relating to the substantive regulation of mortgages.

Appendix E, infra, includes material relating to the Office of the Comptroller of the Currency (OCC)’s regulation of national banks, as applicable both before and after the effective date of the Dodd-Frank Wall Street Reform and Consumer Protection Act (Dodd-Frank Act). This includes provisions dealing with rate exportation, the Dodd-Frank Act’s provisions on federal preemption, OCC regulations, pre-Dodd-Frank Act OCC interpretive and advisory letters and preemption determinations. Appendix F, infra, contains similar material relating to federal savings associations: the statutory provision on rate exportation; Dodd-Frank Act provisions on federal preemption; and OCC regulations and interpretive letters.

Appendix G, infra, provides information on the regulation of federal credit unions. This information includes selected National Credit Union Administration regulations, interpretive letters, and formal statements of interpretation and policy. Appendix H, infra, reprints federal statutes and regulations affirmatively regulating mortgage lending: the federal statute on adjustable mortgage caps; the federal rebate statute; selected provisions of the Servicemembers Civil Relief Act; and selected provisions of the federal Secure and Fair Enforcement for Mortgage Licensing Act (S.A.F.E. Act) and related regulations.

Appendix I, infra, reprints material concerning the Depository Institutions Deregulation and Monetary Control Act (DIDA), including selected statutory provisions, regulations, and federal agency interpretations. Appendix J, infra, does the same for the Alternative Mortgage Transaction Parity Act (AMTPA), including the statute and Consumer Financial Protection Bureau regulations.

Appendix K, infra, reprints federal statutes and regulations governing mortgage loans guaranteed by federal agencies: Federal Housing Administration insured loans, Department of Veterans Affairs insured loans, and Rural Housing Service insured loans. Appendix L, infra, includes federal materials concerning reverse mortgages, including the regulations governing home equity conversion mortgages (HECMs) and Department of Housing and Urban Development HECM mortgagee letters. Appendix M, infra, is a state-by-state listing of state reverse mortgage laws. Failed bank receivership materials are reprinted in Appendix N, infra. Appendix O, infra, lists links to relevant websites.
