1.6.1 Magnuson-Moss Warranty Act Does Not Preempt Other Warranty Laws

There is a strong policy under state and federal warranty laws against displacement of one remedy by another. The Magnuson-Moss Warranty Act states that nothing in the Act “shall invalidate or restrict any right or remedy of any consumer under State or any other Federal law.”169 The Act does preempt certain conflicting statutes dealing with disclosure of warranty terms.170 The interrelation of the Magnuson-Moss Warranty Act and state laws is examined in §§ 2.9, 14.2.9.4, infra.
